High Court Allows RTÉ land zoning review appeal

The High Court has granted RTÉ leave to seek a judicial review of the Dublin City Council decision concerning aspects of the ‘Z15’ zoning assigned to RTÉ’s lands at Donnybrook in the recently adopted Dublin City Development Plan 2011 to 2017. RTÉ previously received a 10-year planning consent for the phased construction works associated with RTÉ Project 2025 from the planning authorities.

RTÉ Project 2025 is RTÉ’s plan for a major national capital renewal project, involving a complete overhaul, modernisation and digital conversion of all of RTÉ’s analogue production facilities at its site in Donnybrook, including buildings, equipment, processes and services. RTÉ was given the go-ahead from An Bord Pleanála for the multi-million euro Project 2025 redevelopment of the Donnybrook site in November 2010.

The redevelopment plan was first announced in September 2009 when a Dublin City Council planned preparation and consideration of a new Dublin City Development Plan required that RTÉ, in common with other major landowners in the city, presented its long-term observations and plans.

As part of the consultation process surrounding the preparation of the Dublin City Development Plan, RTÉ had separately requested the Council to assign a “Z12” zoning to the RTÉ site. This was intended to ensure that the balance of the lands would be used for appropriate and orderly sustainable development. RTÉ has suggested that the site could become a national hub for media, creative and knowledge-based industries.

A release from the broadcaster explains the situation, saying: ”The value of that part of the Donnybrook site not required by Project 2025 itself is directly crucial to the delivery of Project 2025. It forms an essential part of the security which RTÉ requires to enable it to begin to seek to raise the large amount of external funding required to allow Project 2025 to proceed. RTÉ is of the view that restrictions associated with the Amended “Z15” Zoning significantly reduce the value of the site as collateral for security purposes.”
